Description
HELD. - Lafferty was competent to stand trial, even though some experts who examined him believed him not to be competent. Trial court did not abuse its discretion in limiting Laffertys self-representation. Venue was not required to be changed because of pretrial publicity. Jury selection was within courts discretion. Prosecutors opening and closing statements were not improper. Gruesome photos of victims were erroneously admitted into evidence, where Lafferty stipulated to the facts shown in the photos, but error was harmless. In penalty phase: videotapes that were not unduly gruesome were admissible. Evidence of other crimes for which Lafferty was not convicted was admissible, but jury could not rely on it as an aggravating factor supporting the death penalty.
